By virtue of the principle of university autonomy and the nature of an autonomous university entity, as set forth in the article of the Political Constitution of Colombia and Law 30 of 1992, the contracts entered into by the Universidad de La Guajira for the fulfillment of its mission are governed by the rules of private law and their effects shall be subject to civil rules, commercial and according to the provisions of the Contracting Statute of the University of La Guajira (Agreement 015 of 2006, Agreement 006 of 2007, issued by the Superior Council and by Resolution 0589 of 2009, of the Rector's Office) and in some aspects previously defined by the University's own Contracting Statute, by Law 80 of 1993 or State Contracting Statute and other provisions that modify, replace or complement it.

That in accordance with the principles of equality, morality, transparency, economy, celerity, efficiency, impartiality, responsibility, and publicity that govern the administrative function, the Superior Council of the University of La Guajira, by adopting the contractual process, seeks the fulfillment of the purposes of its social object, the continuous and efficient presentation of the public service of higher education and the effectiveness of the rights and interests of the persons and entities that collaborate with it in the execution of such purposes.

It regulates the selection, awarding and signing of contracts, the principles, competencies, exceptional clauses, procedures and requirements for the formation of the contract, in order to ensure transparency in the selection of contractors, the fulfillment of obligations and the correct execution of contracts.
